We, Qey Beauty FZC (hereinafter "we" or "Qey Beauty") are pleased about your interest in our company.

The following terms of use ("Terms” or “Agreement”) govern your access to and use of the Qey Beauty website www.qeybeauty.com (the “website”). Qey Beauty provides its services to you (“site user” or “user”) subject to these terms of use. By accessing or using the website and its associated services, you are agreeing to these Terms and concluding a legally binding contract with Qey Beauty. Do not access or use the website if you are unwilling or unable to be bound by the terms of use.

ELIGIBILITY

We aim to make the website and its associated services available to as many of you as possible. However, we do require that you are at least 18 years of age, able to lawfully: (i) make payment through one of our accepted tender types; (ii) agree to these Terms; and (ii) enter into binding orders with us. The website is for your personal or gift use only and commercial usage is not permitted. We reserve the right to decline orders where we suspect commercial usage.

In order to take advantage of the features and services of this website, you can either utilize the website on a “guest check-out" basis or create an account and register your details with us. It is your ongoing responsibility to make sure that any personal and payment details you provide to us when you register are true, valid, accurate, current and complete. You can update your details either by contacting us here or by updating them in your Qey Beauty account. Please keep your account details and password confidential and secure. We are committed to complying with our Privacy Policy but are not responsible for any loss suffered through misuse of those details. Please notify us as soon as possible if you believe your account has been compromised. By registering or placing an order on the website you warrant that you meet the Eligibility criteria described above and that the information you provide is yours and is accurate in all respects. We reserve the right to close your account at any time for any or no reason.

PRIVACY POLICY

Any information you submit or we collect through the website is subject to our Privacy Policy, the terms of which are incorporated into these terms of use.

ORDERS

When you place an order with us, then subject to your rights to cancel or return the items, you commit to buy the items described in that order, at the price indicated including any delivery fees, taxes and duties where applicable.

All orders are subject to acceptance and availability. If the items ordered are not available, you will be notified by e-mail (or by other means if no e-mail address has been provided) and you will have the option either to wait until the item is available from stock or to cancel your order.

No party other than us has the authority to confirm acceptance of the order. Receipt of your order will be acknowledged by email.

You will assume the risk for the items once they have been delivered to the delivery address which you specified when ordering the items. We accept no liability where you provide an incorrect delivery address or where you fail to collect the items from the delivery address which you specified.

CANCELLATION

You may cancel any order completed with us within 30 minutes of placing the order by contacting hello@qeybeauty.com with a clear statement concerning your decision to cancel this contract. In case of a cancellation, you will be contacted by us to arrange for a refund or store credit. You will only be entitled to a refund for any order price paid if the cancellation is made maximum 30 minutes after the order is placed. If you want to cancel an order completed with us at a later time, please await delivery and use the Returns process.

RETURNS AND REFUNDS

If you wish to return your order (or part of your order), you can do this within 14 days (from the delivery date) for a refund. Returns received outside of the specified returns period will not be accepted. We regret that we are unable to cover return shipping costs or refund the original shipping and duties charges unless the return was due to our error.

Please note: a refund can only be made if the item to be returned arrives in its original condition, undamaged and unused. Items that have been used, altered, or damaged will not be accepted and may be sent back to you and/or a refund refused. We cannot be held responsible for any missing returns or items whilst in transit.

To return an order:

1. Contact us to receive return instructions and address.
2. Ship us the item(s) to be returned with the original packaging, including any associated free products or gifts along with the returned order. Please allow 1-2 weeks for receipt of the return at our office.
3. Once we have received your package, your refund will be issued within 5-7 business days. Any store credit used will populate back to your account immediately.
   
   Refunds will be credited to the original method of payment (e.g., credit card, debit card or store credit). If your purchase was paid with both store credit and another payment method, the store credit portion of your refund will always be issued first. Once the maximum originally spent with store credit is reached, the remainder of the refund will be credited back to your original payment method.
   
   If your return was purchased in a currency other than your local currency, refunds will be paid in the same currency. Due to fluctuations in currency rates the amount refunded may be slightly higher or lower than the price originally paid.
   
   Any delivery costs paid in connection with the order are non-reimbursable or refundable. Moreover, any return delivery and clearance costs incurred by you when returning products are non-reimbursable or refundable.

SHIPPING

Shipping times, costs and duties are dependent on your shipping location and will be displayed at checkout. We ship Monday to Friday excluding public holidays. You can read more here.

GIFT CARDS

A Qey Beauty gift card is redeemable for purchases of merchandise on the website. Qey Beauty gift cards have no expiration date and are non-refundable. The value of any lost or stolen cards cannot be replaced. In the event that a card is non-functional, your sole remedy, and our sole liability, shall be the replacement of such card. The purchase of a Qey Beauty gift card cannot be redeemed for promotional discounts.

PROMOTIONS AND VOUCHERS

Please note

• that our promo and voucher codes do not apply to reduced items and cannot be combined with other promo and voucher campaigns.
• that our promo and voucher codes can also exclude brands. This applies in each case for the promotional period.
• the Newsletter Sign-up voucher can be redeemed once only, cannot be combined with other promo and voucher codes, and you must be logged in with your Qey Beauty account to redeem the voucher. The Newsletter Sign-up voucher is not valid for reduced articles and can also exclude brands.
• the purchase of a Qey Beauty Gift Card cannot be redeemed for promotional discounts.

NO WARRANTY

Except as otherwise provided in these Terms or required by applicable law, we make no representation, covenant or warranty and offer no other conditions, express or implied, regarding any matter, including, without limitation, the merchantability, suitability, fitness for a particular use or purpose, or non-infringement of website membership, any content, or any products purchased through the website.

Your use of the website is at your sole risk and it is provided on an "as is" and "as available" basis. We reserve the right to restrict or terminate your access to the website at any time. Save as required by law, we make no warranties that access to the website will be uninterrupted or error-free; that the website will be secure; that the website or the server that makes the site available will be virus-free; or that information on the site will be correct, accurate, adequate, useful, timely, reliable or otherwise complete. If you download any content from the website, you do so at your own discretion and risk. You will be solely responsible for any damage to your computer or loss of data that results from the download of any such content. No advice or information obtained by you from the website shall create any warranty of any kind.

LIMITATION OF LIABILITY

Nothing along these Terms and Conditions is intended to impact any rights you or we may have under applicable law. We are committed to respecting individual rights including but not limited to moral, cultural and religious rights as enshrined in applicable law.

You may terminate the terms of use at any time by closing your account, discontinuing your use of the website and service, and providing us with a notice of termination by emailing us here.

COMPILANCE

The website may only be used for lawful purposes and in a lawful manner. You agree to comply with all applicable laws, statutes and regulations regarding the website and its use. You agree not to upload or transmit through the website: any computer viruses or anything else designed to interfere with, interrupt or disrupt the normal operating procedures of a computer; and any material which is defamatory, offensive or of an obscene character.

INDEMNITY

You agree to fully indemnify, defend and hold us, and our officers, directors, employees and suppliers, harmless immediately on demand, from and against all claims, losses, costs and expenses, including reasonable legal fees, arising out of any breach of these Terms by you, or any other liabilities arising out of your use of the website or any other person accessing the website using your personal information.

GOVERNING LAW

These Terms and Conditions are governed by the federal laws of the United Arab Emirates and the laws of the Emirate of Dubai and all disputes arising here under are subject to the exclusive jurisdiction of the courts of Dubai, United Arab Emirates.
